Please read these terms carefully before using our services.

1. Introduction and Acceptance

Welcome to Heify. These Terms of Use (the "Terms") govern access to and use of the Heify platform (the "Platform" or the "Service"), developed and operated by:

By accessing, registering or using the Service, the user (the "Customer" or "User") agrees to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use the Service.

2. Definitions

  • Platform or Service:The technology solution offered by Heify that enables the transcription, analysis, extraction and evaluation of audio file data using artificial intelligence.
  • Customer or User:Natural or legal person using the Service.
  • Customer Data:Any audio file, transcription, analysis or information generated or uploaded by the Customer through the Platform.
  • Minutes:Unit of measurement for Service consumption, equivalent to one minute of processed audio.
  • Sandbox:Test environment of the Platform accessible at https://sandbox.heify.com/.

3. Description of the Service

Heify provides a platform for intelligent transcription and analysis of audio files that enables:

  • Automatic audio transcription.
  • Entity and structured data extraction.
  • Smart summary generation.
  • Advanced analytics through interactive dashboards.
  • Quality evaluation of transcriptions.
  • Integration via REST API for developers.

Technical limits, supported file formats and Service specifications are detailed in the official documentation available at https://docs.heify.com/, which is an integral part of these Terms.

4. Registration and Age Requirements

Use of the Service requires the creation of a user account. By registering, the Customer represents and warrants that:

  • They are at least 14 years old.
  • All information provided is truthful, accurate and up to date.
  • They will keep their access credentials confidential.
  • They are responsible for all activities carried out under their account.

5. Pricing and Payments

5.1. Pricing Models

Heify offers two pricing models:

a) Pay as you go

The Customer pays only for the minutes of audio processed. Purchased minutes do not expire.

b) Volume-based plan

The Customer commits to a mandatory minimum monthly volume in exchange for a discount on the per-minute price. This model requires a specific contract.

5.2. Free Trial Period

New Customers receive 100 free minutes to evaluate the Service. No payment method is required to activate the trial.

5.3. Renewal and Billing

Minutes are purchased via manual payment. There is no auto-renewal in the Pay-as-you-go model. For the Volume-based plan, billing occurs monthly as set out in the specific contract.

5.4. Refund Policy

Heify does not offer refunds for purchased minutes, given that the Customer has a 100-minute free trial period to evaluate the Service's quality before any purchase.

5.5. Price Changes

Heify reserves the right to modify its prices at any time. Price changes will be notified to the Customer at least 30 days in advance. Minutes already purchased will not be affected by subsequent price changes.

6. Privacy and Data Protection

Heify processes Customer personal data in accordance with the General Data Protection Regulation (GDPR) of the European Union and applicable Spanish legislation.

Detailed information on what data we collect, processing purposes, authorized subprocessors, security guarantees, retention periods and user rights is available in the Privacy Policy, which is an integral part of these Terms.

Key guarantees:

  • Customer data is NOT used to train artificial intelligence models.
  • Customer data is NOT sold or shared with third parties beyond authorized subprocessors.
  • All data is processed exclusively to provide the contracted Service.

7. Intellectual Property

7.1. Customer Data Ownership: The Customer retains all rights to their audio files and generated results. Heify does not acquire ownership rights over Customer Data.

7.2. License for Processing: The Customer grants Heify a limited license to process their files exclusively for the provision of the Service.

7.3. Platform Ownership: All intellectual property rights over the Platform are the exclusive property of Heify.

8. Acceptable Use of the Service

The Customer agrees to use the Service in a lawful and responsible manner. The following is expressly prohibited:

  • Processing illegal, defamatory, fraudulent content or content that infringes third-party rights.
  • Attempting to access restricted areas or compromise security.
  • Reverse-engineering or attempting to extract the source code.
  • Damaging, disabling or overloading the servers.
  • Reselling or sublicensing access without authorization.

9. Availability and Liability

9.1. SLA: Heify strives to maintain availability of 99% or higher.

9.2. Limitation of Liability: The Service is provided "as is". Heify shall not be liable for indirect damages. Total liability is limited to the amount paid in the current month.

9.3. Development Phase: The Customer acknowledges that Heify is in continuous improvement. Changes in functionality may occur.
